各位長官晚安!有關公教退撫新法問題:我在地方法院值班時曾問出庭律師此問題,他說當我們接到重新核定通知書時請勿簽名,他說一但簽名就表示你接受此核定書,他說退休金核算以退休時所簽文件為主,所以收到核定書後還是要寫一張復審書寄回｛送達｝主管機關,他說此問題可能要集體做｛行政訴訟｝來解決,｛記得如收到又簽字就沒救了｝。

年金是繼續性給付，已經領取的錢不會變動，不會有法律溯及既往的問題。實體法是就已經發生的法律關係從舊，還沒領的年金是還沒發生的法律關係，只是可以預期不代表債權已經成立。而已經退休的公教人員，給付已經經過核定，只是每年給付的計算基礎變動，應該提起一般給付之訴。
